Terms of use
1. Scope of the terms of use and conclusion of contract
(1) These terms of use apply to the MyDieffenbacher Parts portal. The terms of use can be accessed and printed at any time in the portal.
(2) A contract of use is concluded directly between DIEFFENBACHER GMBH Maschinen- und Anlagenbau (hereinafter: Dieffenbacher) and the company using the MyDieffenbacher Parts portal (hereinafter: customer). The subject matter of this contract of use is the free use of the MyDieffenbacher Parts portal. The customer shall inform their employees entitled to use the portal (hereinafter: users) of these terms of use.
2. User account
(1) For using the MyDieffenbacher Parts portal, the user must register and create a user account for which personal data of the user must be collected. If the customer registers the user, the customer must ensure that the data collection complies with the data protection regulations. The correctness of the data is guaranteed by the customer or the users who register themselves. For communication with the user, the stored contact information is used (e.g. e-mail address).
(2) After the registration, the user can log in to the MyDieffenbacher Parts portal with their user name and password ("login data").
(3) The user is obliged to handle the login data with care and to treat them confidentially. In particular, the user is not permitted to disclose the login data to third parties and/or allow unregistered persons access to the MyDieffenbacher portal.
(4) If the user violates their obligations under paragraph 3 above, the customer or user is liable for all activities undertaken using their user account. The customer or user is not liable if they are not responsible for the misuse of their user account.
3. Rights of use
(1) All rights to the contents of the portal (including but not limited to text, images, graphics, sound, animations, videos etc.) or documents made available for download are owned by Dieffenbacher.
(2) Dieffenbacher grants the customer the simple (non-exclusive) right to use the MyDieffenbacher Parts portal.
(3) The customer is prohibited from undertaking any actions (such as the duplication, distribution and/or publication of contents of the portal) which go beyond the intended use in paragraph 2, unless these actions are permitted under mandatory provisions of the law.
4. Obligations of the user and the customer to cooperate
(1) The user undertakes not to post or enter any content on the portal that violates applicable law or public morality. In particular, the user undertakes to observe applicable law (e.g. criminal law, competition law and youth protection law) and not to violate any third-party rights (e.g. rights to a name, trademark, copyright, image or data protection rights) when posting content.
(2) It is not permitted to distribute content which represents, concerns or includes
This also applies if the respective contents do not violate applicable law, the rights of third parties or public morality.
(3) The user shall refrain from any activity that is likely to impair the operation of the MyDieffenbacher Parts portal or the underlying technical infrastructure. This includes in particular:
- using software, scripts or databases in connection with the use of the portal;
- automatic reading, blocking, overwriting, modifying, copying of data and/or other content, unless this is necessary for the proper use of the portal;
(4) If malfunctions occur during the use of the portal or its functionalities or if misuse of a user account becomes known, the customer or user will immediately notify Dieffenbacher of this malfunction.
(5) The customer or user shall inform Dieffenbacher if a user account is no longer used (for example because the employee registered as a user has left the company). In this case, Dieffenbacher will delete the user account.
5. Liability
(1) Dieffenbacher shall be liable without limitation for intent or gross negligence as well as in accordance with the Product Liability Act. Dieffenbacher shall be liable for slight negligence in the event of damage resulting from injury to life, body and health of persons.
(2) In the event of slight negligence, Dieffenbacher shall only be liable for breach of a material contractual obligation, the fulfillment of which is a prerequisite for the proper performance of the contract and on the observance of which the customer may regularly rely (cardinal obligation). Liability for slight negligence is limited to the amount of damages foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected. This limitation of liability shall also apply in favor of the vicarious agents of Dieffenbacher. Dieffenbacher shall not be liable in other cases.
6. Duration of contract
(1) The contract of use shall be valid for an indefinite period of time and may be terminated by the customer or Dieffenbacher at any time without observing a notice period, without any reason being required.
(2) In particular, Dieffenbacher is entitled to immediately block a user if this user violates these terms of use, in particular clause 2 (3), clause 3 (3) or clause 4.
7. Changing the conditions of use
(1) Dieffenbacher is entitled to change or amend these terms of use at any time with effect for the future.
(2) The customer shall be notified of any changes or amendments by e-mail at least six weeks before they take effect.
(3) If the customer does not object to the change or amendment within 30 days after the announcement of the change or amendment, this shall be deemed to be consent to the change or amendment. This shall be pointed out separately in the announcement by Dieffenbacher.
Data protection statement
We are delighted that you are visiting our MyDieffenbacher Parts portal and are interested in our company and our products. We respect your privacy and ensure the protection of your personal data by processing your personal data in accordance with the contents of these data privacy provisions and the applicable data protection laws.
User account
Only registered users are allowed to use the MyDieffenbacher Parts portal. Users are registered by requesting data from the company that is authorized to access. Personal data such as name, gender, e-mail address and the company address is requested. Optionally, the functions of the respective registered user can also be specified as voluntary information (Art. 6(1)(1)(a) GDPR). Where appropriate, self-registration by the user with the above data is also possible.
This personal data is processed by us for the purpose of creating and managing users, for operating the portal and for communicating with the users in the event of inquiries via the portal in accordance with the contract of use (Art. 6(1)(1)(b) GDPR).
All users can have their user profile deleted in the portal – however, they will then no longer be able to use the portal. The request for deletion should preferably be addressed to us by a user via the central user registration of the user's company. In case of doubt, the user may also contact us by e-mail at my@dieffenbacher.
Coverage analysis
In order to constantly develop and improve our portal and to adapt it to the requirements of the users, we evaluate which areas of the portal are visited. However, this evaluation is not user-related. IP addresses on which the analysis is based are pseudonymized in advance by shortening the digits. Conclusions about the behavior of individual users are not possible, not desired and deliberately excluded.
Cookies
Cookies are very small text files used by Internet pages, which your browser stores on your computer and through which certain information flows to us or, if applicable, to a third party.
Transient cookies are automatically deleted when you close your browser. These include session cookies in particular. These store a session ID, which is used to assign different requests from your browser to one common session. This will allow your computer to be recognized when you return to our website. Session cookies are automatically deleted when you log out or close your browser.
Persistent cookies are automatically deleted after a specified period, which may vary depending on the cookie. Unlike transient cookies, deletion does not occur automatically when the browser is closed. However, you can delete cookies at any time in your browser's security settings.
Cookies which are absolutely necessary to provide a service expressly requested by the user ("necessary cookies") are processed by us within the scope of our legitimate interest in providing and operating the website on the basis of Art. 6(1)(1)(f) GDPR GDPR.

Log files
Each time you access our website, we collect the following information about your computer: The IP address of your computer, the request from your browser and the time of this request. We also record the website from which our page was accessed.
